Applying for an H1B or L Visa
Applicants for H1B Temporary Worker Visas must submit via DHL an original copy of the DHS Notice of Action Form (Form I-797), a copy of the original petition filed with the Department of Homeland Security (Form I-129), the Labor Condition Application (Form ETA 9035E), copies of any degrees or diplomas that prove the applicant is qualified for the position (or if qualifying through work experience, a resume and proof of employment for these positions), and any other supporting documents.
Applicants for an L1 visa must submit via DHL an original copy of the Notice of Action Form (Form I-797), as well as a copy of the original petition filed with the Department of Homeland Security (Form I-129), proof that the applicant has been working for the foreign affiliate of the U.S. company for at least one year in a managerial or specialized worker position, and any other supporting documents that prove the applicant is qualified for the position.
Every effort is made to schedule personal interviews within 3 to 5 business days after receipt of the required documents. However, the officer may require additional documentation or investigation in order to decide the case, which may result in delays. In addition, it takes from two to three days from the date a decision is made for the visa and passport to be returned to the applicant. Applicants are strongly advised to allow sufficient time for processing and should not purchase plane tickets until a visa has been issued.
Applicants wishing to renew an H1B or L1 should also submit copies of recent pay stubs or copies of their last three years of federal income tax returns to show they have been working in the U.S. in the same capacity for which they were petitioned in addition to the documents mentioned above.
Dependants of H1B and L1 visa applicants or visa holders should also submit their passports with an original copy of the approved Form I-797 via DHL. Spouses of H1B and L1 visa applicants or visa holders must include an original copy of their marriage certificate. Children of H1B and L1 visa applicants or visa holders must include an original copy of their birth certificate.
